Proposal 1, An Amendment

TEMPORARY ASSIGNMENT OF CITY COURT JUDGES
The proposed amendment to Article VI, section 26,
subdivisions i and j would, if approved, authorize the chief administrator
of the courts to assign temporarily a judge of a city court outside New York
City to the county court, the family court or the district court within his
or her county of residence or any adjoining county, provided he or she is
not permitted to practice law. Such temporary assignments would be in addition
to any temporary assignments provided for by the legislature. Shall the proposed
amendment be approved?
OFFICIAL SUMMARY
Currently, the State Constitution (Art. VI, sec. 26,
subd. j) provides that the legislature may provide for temporary assignments
of judges of town, village or city courts outside the city of New York to
other town, village or city courts within the county of residence or any
adjoining county. The proposed amendment would add a second paragraph to
subdivision j, to provide that in addition to any temporary assignment to
which a judge of such city court is currently subject pursuant to paragraph
1, the chief administrator of the courts may temporarily assign a judge of
such city court to the county court, the family court or the district court
within his or her county of residence or any adjoining county, provided he
or she is not permitted to practice law. The proposed amendment would also
amend subdivision i of section 26 of Article VI to conform the text of that
subdivision to the changes proposed to subdivision j of section 26 of Article
VI.
